Official Contest Rules:

No purchase necessary. By entering this contest, you accept to comply with these contest rules. The contest is void where prohibited by law.

1) You must be at least 18 years of age to enter and a legal resident of Canada.

2) The grand prize will be a no-frills guided trip to Africa to see WaterCan’s clean water and sanitation programs in action, as part of WaterCan’s annual Study Tour in 2009.

3) Videos should be between 30 and 60 seconds long (but a little more or less is okay, too).

4) You must submit your video by sending a Windows Media Video (.wmv) file or QuickTime (.mov) file less than 5 MB by e-mail to contest@watercan.com.

5) You can submit more than one video.

6) All entries must be received by Sunday, October 19, 2008 by 11:59 pm (EST).

7) WaterCan and its panel of judges (link) will choose the finalists and select a winner.

8) The winner will be announced on Wednesday, November 19, 2008 (World Toilet Day).

Additional legal:

9) By submitting your video to WaterCan/Eau vive Corporation (“WaterCan”), you warrant that you are at least 18 years of age at the date that you submit your video and are fully able and competent to enter into the terms, conditions and warranties set forth in these rules. In the event of a dispute about the identity of an entrant, the authorized account holder of the e-mail account used to enter the competition at the actual time of entry will be deemed as such. You may be required to show proof of identification and age and/or proof that you are the authorized account holder of the e-mail address associated with the winning entry. Entries must be submitted by an individual, not a group. Employees, board members, representatives, agents or independent contractors of WaterCan, its affiliated companies and agencies, prize suppliers, members of the contest judging panel or persons domiciled with any of the aforementioned persons are ineligible to participate.


10) By submitting your video to WaterCan, you grant WaterCan a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, and display the video for the purposes of the contest and any current or future public service activities whatsoever including adding the WaterCan logo to it. You will have no right of approval, no claim to any compensation and no claim arising out of the use, alteration or distortion of the video.


11) WaterCan is entitled to remove any material it deems inappropriate, offensive or abusive from either the contest website or its contest channel on YouTube and reserves the right to take appropriate action if illegal material is posted or illegal conduct is suspected.


12) Your personal information shall be collected and used by WaterCan only to the extent necessary for the purposes of the contest and any related public service activities. Your personal details will not be shared with any third party. By entering the contest, entrants agree to the use of the entrant’s personal information for the purposes stated above.


13) The contest officially commences on Saturday, March 22, 2008 at 12:01 am (EST). All contest entries must be received by Sunday, October 19, 2008 by 11:59 pm (EST). Entries will only be accepted online. Illegible, incomplete, or late entries will be disqualified. After the deadline, WaterCan will choose the finalists from among all eligible entries and the panel of judges (chosen by WaterCan) will select a winner from among the finalists. The decision of the judging panel is final. Once the decision has been made, the winner will be notified by telephone and then publicly announced on Wednesday, November 19, 2008 (World Toilet Day). Once the contest winner has been selected by the judging panel, WaterCan reserves the right to notify the contest winner up to ten (10) days in advance of the public announcement on November 19, 2008. By entering the contest, and in the event you are the selected winner or a finalist, you agree to participate in a public event recognizing you and your submission, for promotional purposes.


14) Prize: There will be one (1) grand prize awarded consisting of a seven-day guided trip for the winner to a country in Africa (to be determined by WaterCan), as part of WaterCan’s annual Study Tour, to take place in 2009. The winner will visit some of WaterCan’s water and sanitation projects sites and will be accompanied by WaterCan public information staff and other members of the Study Tour. Approximate retail value of $4,000 CAD. The trip includes economy class return airfare for one from the Canadian airport closest to the winner’s residence to the chosen destination in Africa and six (6) nights accommodation, ground transportation, and three (3) meals per day while in Africa.


15) Prize details not specifically set forth in these rules are at WaterCan’s sole discretion. All taxes, visa fees (where applicable), incidental expenses and gratuities and any other expenses or costs not specified in these rules are the responsibility of the winner. Exact travel dates are subject to airline and accommodation availability, holidays and other restrictions. Trip arrangements cannot be changed by the winner and are subject to change.


16) The Prize must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of WaterCan.


17) Your video must be your own, original work. WaterCan reserves the right to disqualify from the contest any video which infringes the copyright or other intellectual property rights of third parties. You shall be solely responsible for your own video and the consequences of posting or publishing it. In connection with the contest, you hereby warrant that: i) you own or have all the necessary licenses, rights, consents and permissions to submit your video to WaterCan; and ii) you waive any moral rights in your video; and iii) your video does not and shall not infringe the rights of any third party. You agree to indemnify and hold harmless WaterCan from and against any and all claims, damages, obligations, losses, liabilities and expenses (including but not limited to legal fees) arising from: i) your violation of any of these contest rules; ii) your violation of any third party right including without limitation any copyright or privacy right; and iii) your tampering or attempt to tamper with the entry process, the operation of the contest or the contest website. This indemnity will survive the contest. WaterCan also reserves the right, in its sole discretion, to disqualify an entrant for the aforementioned behavior.


18) In entering this contest, each entrant (i) releases WaterCan and its employees, directors, officers, representatives, agents, administrators, and members of the judging panel from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this contest or participating in any prize-related activity or the acceptance, use or misuse of any prize, including without limitation costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom and (ii) grants WaterCan the unrestricted rights, in their collective or individual discretion, to publish without any further compensation the name, picture, portrait, likeness, voice and ideas of that entrant for advertising and promotional purposes.


19) WaterCan reserves the right to amend or terminate the contest and/or these contest rules at any time for any reason without prior notice.
